Black Money Act Defense

Section 43 of the Black Money Act carries a ₹10 lakh penalty for failing to disclose a foreign asset, even where no tax is evaded — it does not bite within the ₹20 lakh de-minimis, but the duty to report stands whatever the value. Peak value is the maximum, over each day the lot was held, of shares multiplied by that day's intraday high and SBI TT-buying rate. The closing price is used only when no daily high is available.

If you still hold anything bought before 2025, also include the statement from the year you first bought it — that's what establishes its purchase cost. No W-8BEN, 1099 forms or trade confirmations needed — but if you have a Form 1042-S, include it: it confirms the year's US dividend income and withholding.

The eight that come up in every foreign-asset filing — answered the way we compute them.

Is Schedule FA reported for the calendar year or the financial year?

The calendar year — 1 January to 31 December — not the April–March financial year the rest of the ITR runs on. Schedule FA for AY 2026-27 therefore covers everything held during calendar 2025. Filing the financial year by mistake is the single most common Schedule FA error.

Do RSUs and ESPP shares in a US brokerage account go in Schedule FA?

Yes — vested RSUs and ESPP shares held with a US broker are foreign equity and belong in Table A3. They are reported one row per lot: every vest and every purchase carries its own acquisition date and its own cost, so clubbing a year of vests into a single row for the stock is wrong.

What is the difference between Table A2 and Table A3 of Schedule FA?

Table A2 is the foreign custodial account itself and takes the cash in it; Table A3 is the securities held in that account. The foreign broker account — Schwab, IBKR, Morgan Stanley, E*TRADE or Fidelity — is one A2 row carrying only un-invested cash, and each purchase lot of shares is its own A3 row. Reporting the securities again inside A2 double-counts them.

Which exchange rate does Schedule FA use — and as on which date?

Schedule FA figures do not all use one annual rate. Acquisition, peak and 31 December closing values use the SBI TT-buying rate for their relevant valuation date under the service's stated convention; gross sale proceeds (including sell-to-cover withholding) use the trade date. Dividend income follows Rule 115 and uses the last published rate on or before the last SBI working day of the month preceding the credit date.

How is the peak value of a foreign holding calculated?

Peak value is the maximum, over each day the lot was held, of shares multiplied by that day's intraday high and SBI TT-buying rate. The closing price is used only when no daily high is available.

What is the penalty for not reporting foreign assets in Schedule FA?

Section 43 of the Black Money Act carries a ₹10 lakh penalty for failing to disclose a foreign asset, and it can apply even where no tax was evaded. It does not bite where the aggregate value of the undisclosed foreign assets — other than immovable property — stays within the ₹20 lakh de-minimis threshold, but the obligation to report the asset stands regardless of its value.

Which ITR form has Schedule FA — ITR-2 or ITR-3?

Both carry it: Schedule FA appears in ITR-2 and in ITR-3, and a resident who held any foreign asset during the calendar year has to file one of them — ITR-1 and ITR-4 cannot carry Schedule FA at all. A salaried employee with RSUs and no business income files ITR-2.
